(3) Multimedia-pool.com grants customers with payment of the agreed one-off payment a non-exclusive, spatially unrestricted right to use the translation/software in the long term. (4) The acquired translation/software together with the files adapted by Multimedia-pool.com is licensed exclusively for the customer specified in the customer account and is exclusively handed over to it in accordance with paragraph 1. (5) A “copy” of the translation/software authorizes customers to use a maximum of one (1) installation of the translation/software simultaneously. The installation of the translation/software may be mirrored for load distribution on several servers (“load-balancing”). (6) If customers intend to use more than one (1) installation of the translation/software at the same time, the right of use must be extended accordingly, ie customers must provide a new or respectively desired number of “copies” of the translation/software of Purchase Multimedia-pool.com. (8) Customers are not entitled to change the translation/software beyond the legal scope, ie, to the extent that this is not necessary for the creation of an interface to other software products or for the removal of errors in the translation/software or edit. However, customers may modify the source code of the translation/software as well as the corresponding database structure of the translation/software assigned by tables at their own risk, in order to adapt them both graphically and functionally to your needs. (9) Copyright notices and other features used for translation/software and source code identification must not be removed or altered. They are to be transferred to every copy of the translation/software. This does not apply if you have purchased from Multimedia-pool.com a “Branding Free” license, by which the customer is entitled to remove the corresponding copyright and other proprietary notices. § 2 Updates (1) Multimedia-pool.com offers at irregular intervals updates of the translation/software. The customer is free to install the respective update. (2) Multimedia-pool.com points out, however, that customers can only fully use the latest versions of the translation/software, with the latest functionalities, when installing the updates. (3) Multimedia-pool.com is exempted from any liability for failure to install any updates, provided that Multimedia-pool.com provides evidence that the defect did not occur when installing the latest updates. § 3 Transfer (1) A resale of the translation/software is only permitted per copy of the translation/software as a whole, ie, abandoning the own use of the compensated “copy”, customers are entitled to transfer the translation/software to a third party for use in accordance with the existing between “Multimedia-pool.com” and the customer agreements for use. Customers are required, upon such transfer to a third party, to delete the translation/software on the remaining media. (2) Customers may not assign the translation/software to third parties if there is a reasonable suspicion that the third party will violate these license terms, in particular to make unauthorized copies.
